Industry Standard Waiver & Terms
Please read before booking. (General template — not legal advice. Consider having an attorney review for your state and insurance requirements.)
1) Passenger Agreement
By booking or riding with Excellence (“Company”), you (“Client/Passenger”) agree to the terms below.
2) Assumption of Risk
Client/Passenger understands that vehicle transportation involves inherent risks, including but not limited to traffic accidents, sudden stops, road hazards, and actions of other drivers. Client/Passenger voluntarily assumes all such risks.
3) Release of Liability
To the fullest extent permitted by law, Client/Passenger releases and holds harmless the Company, its owners, employees, agents, and contractors from any claims, demands, damages, losses, or expenses arising out of or related to the ride/service, except to the extent caused by the Company’s gross negligence or willful misconduct.
4) Seat Belts & Safety
All passengers must wear seat belts at all times. Client/Passenger is responsible for ensuring minors are properly restrained in accordance with applicable laws (car seats/boosters as required). Company may refuse service if safety requirements are not met.
5) Conduct & Damage
No smoking/vaping inside the vehicle unless explicitly approved. Client/Passenger is responsible for any damage, excessive mess, or cleaning required due to actions of Client/Passenger or guests. Additional cleaning/damage fees may apply.
6) Late Arrival, Waiting Time, and Itinerary Changes
Pickups may include reasonable waiting time. Excessive waiting time, route changes, additional stops, or extended service may result in additional charges. Company will communicate changes when possible.
7) Payment, Deposits, and Refunds
If Client/Passenger pays in advance, payment secures the requested time window. Cancellation/refund policy should be added here (example: 24–48 hour notice for refund). Replace this paragraph with your official policy.
8) Force Majeure
Company is not responsible for delays or cancellations due to events beyond reasonable control (severe weather, road closures, airport delays, accidents, law enforcement actions, etc.).
9) Media
Client/Passenger may not record the driver without consent. Company may use non-identifying photos of vehicles for marketing.
10) Acceptance
By booking service, signing below, or checking agreement on the booking form, Client/Passenger acknowledges reading and accepting this waiver and terms.
